regulation of ethics of professionals

I want to know whether anybody knows anything about the state of the law in terms of professional conduct when a psychiatrist or psychiatric nurse becomes involved with a patient. In the state where this happened the professional body of a nurse said that they would not make a finding of professional misconduct against a nurse who they found had been proven to have abused his position of trust in enticing a patient into a sexual relationship who had been under his care. He was many years her senior and used his authority to do so. Their reasoning was that there had been a recent ruling where the Board had been sued for even investigating a nurses' conduct and there had been a precedent set which made some distinction between the health professional engaging in a relationship after the therapeutic relationship had ended, or after the patient was discharged and when they were directly under their care. The facts of the case were quite unique, and didn't suggest that there had been a misuse, but the precedent was disturbing. So too was the attitude of the professional body, ie we don't want to get sued. So there was an open admission as to why they did not feel that this particular nurse should be found guity of professional misconduct. It had more to do with defensiveness legally than making sure ethics were upheld and that the nurse did not do any further damage.
